Trial court’s decision denying class certification affirmed on appeal! The California Court of Appeal issues a decision in Lauren, et al. v. LendingTree, LLC, et al., Case No. G042932, affirming the trial court’s refusal to certify a class of borrowers seeking more than a hundred million dollars of damages from LendingTree and its subsidiary Home Loan Center. According to the Court of Appeal, the trial court properly denied class certification because the plaintiffs “could not show standing to sue and could not carry their burden to show that common issues predominated over individual ones.” SH&L partner Jon Hersey represented LendingTree and Home Loan Center in the trial court proceedings, and drafted their oppositions to the motion for class certification and briefings on appeal.
